DESCRIPTION:🇬🇧 \nThe Ukraine Legal Network is launching a “Barometer” research  to assess awareness among Ukrainians residing in the Netherlands about the Register of Damage for Ukraine established in the Hague by the European Commission. \nThis initiative aims to gather feedback from the Ukrainian community regarding their knowledge of the available options for claiming compensation for losses and damages they have suffered due to Russian aggression in their homeland. \nULN is a part of this community and has been created to respond to the Ukrainian community’s needs. By working on the ground\, interacting with survivors\, and seeking ways to support and guide them towards justice\, the Network is dedicated to fulfilling its core mission. \nThe International and European community together with the Ukrainian government\, along with the President\, has made significant efforts to develop and establish a compensation mechanism for all victims in Ukraine.  \n The establishment of the International Register of Damage for Ukraine in The Hague is a critical first step toward ensuring justice and enabling compensation for victims\, aiming to support those affected even before the war’s conclusion.  \nIn the light of this\, we invite Ukrainians to take part in our questionnaire and make an input in assessing the community’s awareness of the Register of Damage and the broader compensation mechanism. \nThis research is designed to help us better understand and amplify concerns and hesitations of the Ukrainians. \nThe project will be carried out in two phases: \n\n Conducting comprehensive research to collect data;\n Sharing received results\, highlighting the key findings to policymakers\, legal experts\, and relevant stakeholders\, ensuring that victims’ voices are heard and acted upon.\n\nAll collected information and feedback will be carefully analysed and systematised. DESCRIPTION:Ukraine Legal Network is hosting a Moot Court in “Ivashchuk vs Russian Federation” Case. \nDate: 21 October\, 17:15 – 20:00\nLocation: University of Amsterdam (UvA)\, Moot Court Room A3.15 \nLanguage: Ukrainian \nUkraine continues its pursuit of justice\, even in the toughest of circumstances\, and this innovative moot court on compensation for damaged property using open source evidence under Ukrainian civil law is an important step towards seeking justice. \nMoot Court is a simulation of legal proceedings\, and this innovative session organised by Ukraine Legal Network together with our partners OSINT For Ukraine offers participants an opportunity to delve into the complexity and intricacies of international legal regulations and Ukrainian legislation\, focusing on human rights violations and compensation for damages caused by Russia’s war against Ukraine. The court session will also highlight the use of OSINT (Open-Source Intelligence) evidence in legal proceedings to support claims and hold perpetrators accountable.  \nThis session will cover the case of “Ivashchuk vs Russian Federation” on compensation for destroyed property in the occupied territories. \nPartner:\nOur partner is OSINT for Ukraine Foundation\, which plays a crucial role in supporting the investigation and evidence gathering for this case. OSINT for Ukraine specialises in using OSINT to document war crimes and human rights violations. Their work is instrumental in collecting the evidence needed to pursue justice for the victims of the war in Ukraine. \n  \nAbout the “Ivashchuk vs Russian Federation” Case \n\nPlaintiff (fictional person): Mariya Ivashchuk\, a Ukrainian citizen who lost her home in Mariupol due to Russian military actions and the occupying administration.\nDefendant: the Russian Federation.\n\nThe case revolves around a claim for compensation for the destruction of the plaintiff’s home\, including material damage and emotional distress. A key element of the case is the use of OSINT evidence and digital materials to prove property destruction in areas inaccessible due to occupation. \nCase overview:\nIn February 2022\, Mariya Ivashchuk and her family were forced to flee Mariupol after the Russian invasion. Their apartment was damaged in the shelling and later completely destroyed. Now\, a new residential complex has been built on the site of her former home without any involvement of the rightful owners. \n  \nKey legal challenges:\n1. Overcoming Russia’s legal immunity.\n2.Using digital evidence to prove the destruction of the property.\n3. Seeking rightful compensation for the destroyed and demolished home. \nThe plaintiff’s lawyers will present solid evidence and arguments about the violation of Mariya Ivashchuk’s property rights. \n  \nWhy This Case Matters:\n1. Harmonisation of Ukrainian legislation with international norms: The use of OSINT evidence in Ukrainian courts is important when the access to evidence is limited.\n2. Protecting the rights of war victims: Restoring justice is possible through filing lawsuits to protect the rights of victims.\n3. SUMMARY:International Criminal Law & Universal Jurisdiction: Presentation by Hope Rikkelman\,  Head of Syria & Iraq Projects at The Nuhanovic Foundation
DESCRIPTION:On 7 November 2023\, Hope Rikkelman\, Head of Syria & Iraq Projects at The Nuhanovic Foundation\, gave a presentation to Ukraine Legal Network (ULN) members about the organisation’s long-standing work in the area of International Criminal Law and Universal Jurisdiction. Next to its focus on information-sharing regarding the experience of investigating and prosecuting grave international crimes in the Dutch jurisdiction and The Nuhanovic’s strategic focus in this regard\, this event also served as preparation for a court visit ULN is organising on 30 November 2023 to attend a groundbreaking crimes against humanity trial in The Hague: the first-ever Syrian regime-related criminal trial in The Netherlands. \nMs. Rikkelman explained how the Dutch Police’s International Crimes Unit and Prosecutor’s Office investigate and prosecute international crimes in the Netherlands and related this to details about the latest case that the Dutch war crimes prosecutor is preparing to take to trial on 30 November 2023 regarding the conflict in Syria. \nThe ensuing discussion included the topic of the role of civil society organizations in triggering these kinds of cases and the difference between national and international prosecutions of international crimes. This provoked the question whether the future of international justice lies in domestic courts. Zooming out\, participants considered the larger value of criminal trials next to their punitive characteristic\, for example as a platform for victims to be heard and as efforts to document and archive information as legal facts including for future generations.

SUMMARY:Study Visit to the International Criminal Court
DESCRIPTION:The Ukraine Legal Network organised a study visit to the ICC and facilitated interaction between its members and ICC officials. The visit began with a general presentation on the ICC outlining the main characteristics of the Court\, including specific crimes within its jurisdiction\, complementarity and individual responsibility. The visit gave ULN members an opportunity to witness the courtroom and attend a presentation about the role of participants in proceedings\, including as regards the role and qualifications of judges and prosecutors. \nNotably\, ULN members also had the chance to meet and interact with Dr. Philipp Ambach\, Chief of Victims Participation and Reparations Section at the International Criminal Court\, who kindly shared his knowledge and experience in the field and outlined how victim participation is organized at the ICC. Dr. Ambach also provided insights into how retraumatization can be avoided while approaching victims\, and the process through which victims of international crimes can reach out to the ICC in order to contribute to ongoing investigations and\, hopefully soon\, prosecutions.
